“Many times people aren’t ticketed when they are in a car accident, but that doesn’t mean that the police officer hasn’t actually assigned fault in his traffic report. If you have a traffic report and you look at it, there are codes, numerical codes, and oftentimes an officer will cite someone for failure to reduce speed, failure to yield, improper turn, things like that, on the accident report without actually charging someone with a criminal infraction or misdemeanor. I think that’s largely within an officer’s discretion. If the opposing party isn’t given a citation when you’re in a accident that doesn’t mean that they will not be found liable, and it doesn’t mean that the insurance company won’t accept the fact that their client was negligent.”
