Multiple Offenders

  • If you are facing a second conviction for DWI within the last 7 years, and there are no other aggravating factors (grossly or otherwise), then you are potentially facing a fine of $2,000.00 and sentenced to a term of imprisonment of not more than 12 months. You will not be eligible to receive a limited driving privilege and your license will be suspended for four years. However, upon completion of 2 years without any subsequent traffic charges and other imposed conditions, the court may in its discretion grant limited driving privileges.
  • If you are facing a conviction for a third DWI/DUI in 7 years and are indeed convicted, you are facing a fine of $4,000.00 and imprisonment for a term not to exceed 2 years (24 months). You are also facing a “permanent” suspension of your license, although you may request a hearing to reinstate your driving privileges after 5 years.
  • It should be noted that a District Attorney may offer a prior conviction outside of 7 years as an aggravating factor (less severe than grossly aggravating), thereby increasing your punishment from Level 5 to potentially a Level 3.
