This is the test that counts. In North Carolina two good reads of .08 or greater on the Intoxilyzer is per se evidence of impairment. You may be thinking, why would I ever submit to this test if that’s the case? Well, by obtaining a driver’s license and driving on public roadways and vehicular areas, you have impliedly consented to being tested for drugs and alcohol if there is sufficient reason to believe that you were impaired while operating a motor vehicle. In other words, you really don’t have a choice. If you refuse you will either cause the law enforcement officers to obtain a warrant to draw blood (which is debatably necessary), or in the alternative a refusal will automatically suspend your license for one year.
